2. Application of These Terms

These Terms govern all sales of goods through our website.
By placing an order, you confirm that you are a consumer purchasing goods for personal use and not for resale or business purposes.
If you are buying for business use or resale, please contact us before ordering so we can supply appropriate business terms.


3. Definitions

  • Consumer – an individual acting wholly or mainly outside their trade, business or profession.

  • Contract – a legally binding agreement between you and Project Scent Ltd for the supply of goods.

  • Goods – the items listed and described on our website.

  • Order – your request to purchase goods via our website.

  • Delivery Location – the address you specify for delivery.


4. Description of Goods

All goods are handmade and described as accurately as possible.
Because our products are individually crafted, colours, shades and patterns may vary slightly.
All goods shown on our website are subject to availability.
We reserve the right to make small changes required by law or for product safety.

We handle all personal data in accordance with our

and Cookie Policy.
By ordering, you consent to our use of your information as set out in those policies.


6. How the Contract Is Formed

  1. Product listings on our website are invitations to purchase only, not offers.

  2. You place an order by completing the checkout process and submitting payment.

  3. We may reject or cancel an order for any reasonable reason (for example, stock unavailability or suspected fraud).

  4. A legally binding contract forms when you receive an Order Confirmation Email from us.

  5. Please check your Order Confirmation carefully and contact us immediately if any details are incorrect.


7. Price and Payment

  • Prices shown on our website include VAT (where applicable).

  • Delivery costs are displayed at checkout.

  • We accept the payment methods shown at checkout.

  • Payment is taken at the time you place your order.

  • Any promotional offers or discounts apply only as stated and may be withdrawn at any time.


8. Delivery

  • We deliver within the UK (mainland, Northern Ireland, Isle of Man and Channel Islands).

  • We aim to dispatch orders promptly, and always within 30 days of order confirmation unless otherwise stated.

  • Risk in the goods passes to you once they are delivered.

  • Ownership passes only once full payment is received.

  • We may deliver items in separate shipments if necessary.

  • If your parcel cannot be delivered because of an incorrect or incomplete address, you will be responsible for re-delivery costs.

Incorrect or Incomplete Addresses
Please ensure the delivery address entered at checkout is accurate.
If your order is returned to us due to an incorrect address, we can reship once the additional postage has been paid.
If you prefer to cancel, we will refund the product cost only (excluding original shipping).


9. International Deliveries

We generally do not ship outside the UK.
If we agree to an international delivery, the buyer is responsible for any import duties or local taxes.


10. Your Right to Cancel (Consumers)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days without giving a reason.

The cancellation period expires 14 days after:

  • the day you (or someone you nominate) receives the goods, or

  • the day of the first delivery for subscription or recurring orders.

Exceptions

You cannot cancel for:

  • Goods made to your specifications or clearly personalised;

  • Goods which are likely to deteriorate quickly (e.g. bath or body products once opened);

  • Goods which, after delivery, are inseparably mixed with other items.

You may use our model cancellation form, but it is not required.
We will confirm receipt of your cancellation by email.


11. Returning Goods After Cancellation

  • Please return goods within 14 days of notifying us of cancellation.

  • Items must be unused, in original packaging, and in resalable condition.

  • You are responsible for the cost of return postage unless the item is faulty.

  • Once received, we will refund the goods and standard delivery cost (if applicable) within 14 days using your original payment method.

  • If items are damaged or show signs of use beyond what is necessary to inspect them, we may deduct an amount to reflect the loss in value.


12. Faulty or Damaged Goods

If an item arrives damaged or develops a fault within a reasonable period, please contact us at contact@projectscent.co.uk.
We will repair, replace, or refund in line with your rights under the Consumer Rights Act 2015.


13. Conformity

We have a legal duty to supply goods that conform with your contract.
Goods will be:

  • of satisfactory quality;

  • fit for their intended purpose; and

  • as described on our website.


14. Privacy and Data Protection

We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We are the Data Controller for personal information collected via our website.
We use appropriate technical and organisational measures to protect your data.

15. Limitation of Liability

Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • any matter where it would be unlawful to limit or exclude liability.

Subject to the above, we are not responsible for:

  • any loss not reasonably foreseeable at the time of order;

  • business losses (including loss of profit, revenue, or goodwill) where goods are purchased for personal use.


16. Governing Law and Jurisdiction

These Terms and the Contract are governed by English law.
Disputes may be brought in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.
